Are the police wanting to speak with you? Proceed with caution. As an experienced criminal attorney in Houston, Texas, I’ve seen many individuals face charges immediately after denying their involvement in crimes.
It typically starts when an officer asks someone to come on in and “give their side of the story”. Naturally, the officer was nice and polite, but only because they know it’s difficult to get a scared person to the station. My client provides a statement denying any involvement. My client is then arrested for a warrant either right there at the station or a few days later after the Assistant D.A. has reviewed the case (and my client’s statement).
So, despite what my client had to say regarding their side of the story, the police still arrested them. Why? Maybe the officer already had his or her mind made up regarding who was the guilty party. Maybe the officer just wanted to see if the person would give a confession and make the case that much easier to prove. Either way, my newly charged client did not benefit in any way by providing a statement.
Even if the police officer wants to conduct a phone interview, that phone line will be recording the conversation. Please don’t think that you are “safe” by “testing the waters” over the phone. I have found that usually, the first person to call the police is the person who gets arrested, regardless of the facts. In addition, if you are voluntarily speaking with the officer over the phone or in person, that officer does not have to read you your rights because you are not under arrest.
Always consult with an attorney. And don’t take legal advice from your granny, sister, friend that has been to jail 50 times or your cousin that is a constable. It is not my opinion that all police officers are unfair, but you cannot run the risk of taking that chance.
