there will be portion of it to compensate loss of income (past and future) and other for pain that is on going. My best guess is past income ($48K-most recent income $19K) multiply 4 yrs less lawyers fee= $86K…I am hoping to get closer to settlement soon but wish to get funds in the new yr for tax purpose cause this would cause such additional headaches.

I was in a car accident over two years ago. Can someone w/ experience help me figure this out?

I’m surprised your workers compensation didn’t apply, since you were on the job–unless your employer didn’t carry W/C coverage. In that case, if the driver was uninsured, your employer’s uninsured motorist coverage applies. A judgement against the driver doesn’t automatically mean you’ll get the amount of that judgement from your employer’s uninsured motorist policy. Most such policies have an arbitration clause in the contract language, which means you can’t sue the insurance company if you can’t agree on a settlement and meaning that, if you can’t agree , it must go through arbitration. In that case you and your attorney and the insurance company’s attorney split the cost of the arbitrator (usually a judge or professional arbitrator) who listens to/reads the arguments for both sides before he/she issues a decision. Also, the settlement is limited by the limit of coverage on the uninsured motorist coverage–often $100,000, although it could be more or less. So, bottom line is that the judgement against the at-fault driver has no bearing on your settlement with the insurance company . Once the insurer pays the final settlement to you and your attorney, they will go after the at-fault driver to recover their payment, which is limited to whatever the judgement against him was. The likelihood is that they’ll never see a dime of it. If the driver was uninsured, it’s doubtful he or she has any assets to pay a judgement or subrogation claim. New Jersey has some really wierd insurance codes, including tax-payer-paid insurance (JUA), which could complicate the whole thing even more. By the way, since you’ve been recently called to give a deposition, it means you’re still in the “discovery” process and a long way from getting down to a decision by the arbitrator.

How do I find out what happened to the person that hit me in a car accident in Texas (SAPD). ?

My boyfriend was hit from behind full force at a stop light by a guy that ran after the accident. The cops were able to catch the guy and after the arrest we were told he was going to perform a field sobriety test before taking him in. After my boyfriend was released from the hospital after surgery to remove a blood clot in his brain we got a copy of the police report. I bought a vehicle and the carfax report says that there is frame car damage?

I bought a vehicle and the carfax report says that there is frame car damage on this vehicle. Bought the car about 7 month ago and i am still making payment on it. The day that i bought the car the manager of the car dealership did not tell me about this damage, i am trying to sell the car that is when i discover that there is frame damage on this car via carfax. I called the dealership and i was told that there is noting they can do about and that they are not obligated by law to tell me the car history and however they are not aware of the accident. my question is should i get a lawyer in-regard to this or what can i do. the business is done in the commonwealth of Virginia. how can i returned my car back to the dealership.

Dealer is under no obligation to take the car back. They are only obligated to tell you if the car has a salvaged title or has been a lemon buyback. They don’t have to tell you every accident it was in….. which is not possible since they don’t know the entire history of their cars.

The car belongs to you. You can sell it at a big loss since other people check Carfax before they buy…. or continue driving it.
