Getting a misdemeanor erased or hidden from my record?
I live in florida and i have a retail petty theft on my record from 9 years ago and also a dui from 4 years ago. Would i be able to get a lawyer to get the theft charge taken off of my record and what would he typically charge if they could do it?
Not all jurisdictions allow expungements of criminal records. Petit theft is minor enough that you should be able to handle it yourself. Stop in at the Clerk of Courts in the county of the arrest/conviction. Ask if they allow expungements. If so, ask for a motion to expunge a misdemeanor. It is relatively simple form to fill out. Return it to the Clerk’s office with the appropriate filing fee. A court appearance is usually not needed for this ( although the Clerk’s office will tell you if it is). You will be notified by mail of the decision.
As noted above me, an expungement will not take the conviction completely away. It will be locked in a sealed area that is accessible only to law enforcement and the court system ( in case of a repeat violation during your lifetime). Other than that , it will not exist to public viewing in a background check and you can legally answer “no” where it asks if you were ever convicted.
If you feel the form is too challenging for you, a lawyer can draw this up. The average cost for a misdemeanor expungement runs between $250 and $500, depending on how the lawyer values his time.
