DUI charge, police did not see driving.?
I know I made a stupid mistake, but please don’t give me a guilt trip. Im the one that has to live with this…Serious answers only please.
I have a preliminary hearing this week for a DUI from June. This is a first offense and I’m in PA. What happened was there was an accident (no other cars, no witnesses, no damage to my car – long story) Anyway, the police came to the scene when we called 911. They did not see me driving the vehicle, but gave me a breathalyzer and took me for blood test.
Is it possible this could be thrown out as there was no witnesses and I didn’t get pulled over?
What should I plea when i go for the prelim? I know there is the BAC test results and breathalyzer results against me…
Any help is appreciated. Oh, I do have a lawyer.

You were drunk, do the right thing and STOP TRYING TO GET OUT OF IT.
And please don’t do it again, for the sake of all the innocent people out on the roadway when you’re drunk arse is driving home stupidly.
