What are the chances of not going to jail for a violation of probation?

My friend was on probation for a dui he got in Feb. 2006. He wasn’t on track to complete all of his community service hours on time (10 hours per month), so the p.o. violated him. He found out there is a warrant for him in Florida but he now lives in Raleigh, NC and is in college and working. He has finished all of the hours now and paid all the fines. He spoke to some attorney in Florida who said that with his legal services they would try to get the warrant recalled and have the probation terminated. What should he do? Is there a chance the courts would recognize the fact that he is in college and working at all or does that just get thrown out the window? The main focus would be avoiding jail time or getting as little as possible.

His attorney should be able to work things out on his behalf. If he’s finished his community service, paid all fines and has a future. However, it depends on Florida’s laws and i know they are not too keen on DUI’s, especially if he moved w/o finishing what the judge required him to do. Also, does he have a drivers license or was it suspended? If it was suspended and he’s still driving….NOT A GOOD IDEA! They are not going to pick him up on a warrant in another state for a first time offense. If he gets in ANY trouble in NC they will find out about his warrant in FL and it will be up to FL to have him transported back to their state for violation. My suggestion, is for him to have his attorney take care of this while he’s in NC so that when/if he ever returns to Florida, he is not arrested. They won’t go out of their way to arrest him for this offense, but you’d be surprised on how kharma kicks us all in the A**! Good Luck to your friend and it’s great he is doing well!;)
