Need advice on DUI in California?
This is what happened: Nite was Halloween and my friend (who is a minor) led to the house (there were 3 shots about 2 hours before he was driving) and was intercepted. The police were very cold with him and make him a breath test, but said that since he was a minor and admitted to drinking, they had to take it in. It ended up driving around in the car (at the same time attracting more people and more) till 3am, at which time blood was analyzed. He was released the next day, but must pay a deposit or something. He said he felt completely lucid on this point. The results did not return for 2 weeks, but meanwhile, seek advice on whether or not we should hire a lawyer and if this can happen if the test Blood returns showing less than 0.08?
