Wisconsin Law? resisting arrest and disorderly conduct.?

A friend of mine went to the state of wisconsin from the state of Minnesota with his ex – and children, he was dropping them off then on his way back to Minnesota. He apparently stated drinking according to his ex and he asked the police to shoot him, and he was arressted for disorderly conduct and resisting arrest,he’s in jail in Madison, the county he’s in is Clark. I’m just curious, how time counld he possibly get for charges like this? he does have a past criminal record but only in the state of minnesota, hopefully a lawyer or police officer can answer this question for me. please no rude conments!

If the incident involved his ex, then it would be a domestic disturbance. Wisconsin does aggressively prosecute domestic violence. I’ve included the state statute numbers in parentheses, you can look them up yourself using the link at the end.

Resisting arrest (946.41) is a Class A misdemeanor in WI. The maximum penalty is a $10,000 fine, a year in jail, or both. Disorderly conduct (947.01) is a Class B misdemeanor. The maximum penalty is $1,000 fine, 90 days in jail, or both.

Wisconsin also has a penalty enhancer for prior offenders (939.62), including offenses from other states. The 1 year in jail for resisting could be doubled.

I doubt he will get anywhere near the maximum, but he is certainly looking at some time in jail.
