Would this be “non performance” of a lawyer? (in Pa.)?

i was involved in a really horrible car accident in 2002, and i hired a lawyer, he sued a local establishment that overserved the defendant alchohol (dui- “dram shop suit”), anyway, i had approx. 1.2 million in medical bills by the time i left the hosp., 6 months later, we settled in 2004. he was suppossed to include all med. bills in this,-i had to settle with DPW to pay back since i was on keystone mercy at the time,anyway i paid them quite alot, but come to realize he “forgot” to include some bills!, they are on my credit, collection agencies,etc.they’re giving me bad credit now! about $12 worth! would this be non-performance, if he did not take care of these as he was suppossed to? a friend mentioned the term to me and told me i should call a lawyer-maybe sue him? just wondering what i can do, and what the laws/torts are in pa.? thanx…

contact a 2nd attorney for advice; if attorney did not settle all, then could be held for malpractice.

there could be issues that he settled for less; most states allow 1/3 less with a lawyer and they maybe trying to collect the balance not owed.

were any of these bills incurred after you settled?

also, the providers may have billed for some services but did not include all and later found outstanding, so he could not pay. that could be an issue with the providers not submitting.

there are so many issues, that only a professional would have to look at all of the issues to give you legal advice on your rights.

please note; most lawyers will not sue another lawyer, just like doctors will not go against other doctors; they always think, that someday they maybe in the same position of making a mistake and dont want someone to sue them.
