Legal shenanigans?
I was in a car accident a few years back. Have been in litigation since. Other party deemed 100% at fault. Have been offered settlements but turned them down. Work doctor wont let me return. So… I went to, in ontario canada, what is called ” court ordered mediation”. My lawyer and I where surprised with some video survelence tapes. The tapes showed nothing at all damaging to my case. But. My lawer was unhappy that these tapes were just given to us now. These tapes were filmed last july. In august last year I went to discovery. My lawer asked the other lawer on the record if there was any video survelance of me? The replied “no” Now.. 2 Months ago I attented an appointment with a doctor who was paid for by the insurance company. He examined me and rendered his report. My lawer also found out today that this doctor was given copies of these video tapes aswell.
Are they legaly allowed to do this? Or have they violated the law and my rights?
This is in Ontario, Canada.
I don’t think that the opposing side is legally permitted to enter those video tapes as evidence in a court of law. Is this in America, or Canada? I know you said the mediation is in Ontario. So the event took place in Canada? I don’t know anything about Canadian law. But I believe that if it were in the U.S., the opposing counsel would not have the right to admit that evidence into court, because they did not present it during the discovery period.
