Reckless driving ticket for hydroplaning your car?
A good friend of mine recently received a reckless driving ticket (in Fairfax, Virginia). He was driving home from class, it had just started raining, and his car hydroplaned. He skidded into and under an 18-wheeler. He was NOT speeding, he was going 5 under the speed limit. The cop that came to the accident scene gave him a ticket for Reckless Driving-Improper Control of Vehicle” Can he do this? The cop was not there, and did not see the accident, or check his speed in anyway. Since the ticket is not for speeding or improper lane change or whatever, and there is no witness, how can the cop say he was driving improperly? I looked up VA laws, there are many forms of Reckless, but none that match what this cop charged him with-any help? My friend is lucky to be alive and doesn’t need to hire a lawyer after all this BS! Thanks!
the speed limit is for perfect conditions. If he lost control that means he was going to fast for the conditions of the road. Thus reckless driving.
