Need advice..should i sue?

About 3 weeks ago my car was sideswiped by some lady from out of town ( i an in Iowa..she is from Alabama) She wanted to write me a check on the spot and leave. Instead i called the cops and had them write down a report. She asked me to not call her Ins company and that she would like to pay out of pocket. I called my ins company and they advised me to go through her ins company for my own sake.
so i called and 3 days later they called me back. They took all the info and said that they would have to talk to her. than i got a call saying she will not answer he phone and they are not going to fix my car till she talks to them. I have a police report saying its her fault and she even got numerous tickets due to the accident. All i want is for my car to get fixed Should i have my ins company go after her or should i get my lawyer involved? thanks

I would attempt to allow the insurance company to pursue payment and if that does not work contact a lawyer and go to civil/small claims court.
