Settlement of a car accident very low, leading to small claims court?

I was struck by a car he was to blame. 15K negligent driver is all used to process the prosecutor because he has nothing. I'm about 30K for medical expenses and need care for my broken leg. Due that son of a bitch has caused me many problems and money, I would like to take this to small claims court and try to get the maximum, I think is 5 km (California). I did sign a waiver of 15K and then told him that the man's fault is always empty / fully paid for everything he has done. Does this mean I can not carry it trial in small claims court? I know 5K is not much compared to everything I lost, but so I want that thing to pay the man and perhaps force him to reflect on what he did. While return will be greatly appreciated. Thank you. This man was negligent and should never be allowed to drive again because it can kill someone.
