Auto Accident: What to do? What to ask for?..?
I had an accident this past Saturday on April 31st. I live in Lubbock Tx and was traveling to Houston Tx, which is about 10 hours away and t-boned a vehicle who was trying to rush into a convenience store. My vehicle was totaled and the other driver recieved a ticked for failure to yield to the right away. So as you can see “not my fault.” I went to the doctor and told me that I had whiplash and my cyrvical spine is straight instead of bent and now I am stuck in this neckbrace for 3 weeks. I have already recieved a rent a vehicle. I am just wondering what should I ask for when it comes in the terms of money for the accident, 3 plane tickets home, and having to rent a hotel for the night, also pain and sufferering, and also my lost wages. I am only 19 years old and am trying to do this without a lawyer, because my sister just got her settlement which took a year and a half and frankly i can’t wait that long. You can settle your claim whenever you want and lawyer isn’t necessary–they add no value to your claim, and the value is what your settlement is based upon.
Get all your receipts & medical records (reports, doctor notes) and bills (showing the CPT codes & ICD9 codes–these are on a HICFA form at your docs office) together and submit them to the insurance asking for $XX and go from there. If you need future treatment, get an estimate of charges from your doctor & a statement describing what it is & why it’s needed. This is also considered. For your wage loss, you better have a disability slip of some sort from your doc & you better be able to prove 1) your hourly wage and 2) the number of hours you are scheduled to work.
