Should my husband tell his employer that he has Parkinson’s?
My husband is 46 and recently diagnosed with Parkinson’s disease. He has been a truck driver (18 wheeler) for 26 years. He works for a large company and was hired a year ago, passed his physical. He didn’t know he had Parkinson’s at that time. His neurologist says that he is good to drive for many more years. My husband worries that if he tells his company that he has Parkinson’s that they will not want him to drive for them anymore or that they will fire him. He worries that if he were in an accident and didn’t tell them about his Parkinson’s that they might try to blame the accident on him or his new medications, even if it wasn’t his fault. He would like to be upfront with them, but doesn’t want to loose his job. We live in Texas. Texas Labor Laws suggested I ask a lawyer. Thank you.
If he tells them and they fire him, they’ve violated the Americans With Disabilities Act and the Texas Labor Code. I don’t know if he has to tell them. Does he have an employment agreement that requires it? Is there a personnel policy or handbook that requires it? If not, he does not have to tell them until it affects his ability to do his job. HIPAA laws protect the privacy of this information. So, does he need the employer to do anything at all to accomodate his Parkinson’s? If not, he doesn’t not have to tell. If yes, he has to tell his employer so the employer can make reasonable accomodations for his disease. I actually was in trial on this issue yesterday.
